We will do our best to attend within agreed timeframes, but delays may occur due to breakdowns, weather, travel conditions, supplier delays, safety requirements or other factors outside our control.

8. Parts, materials and suppliers
Parts, materials and components may be sourced from third-party suppliers.
Availability, pricing, delivery timeframes and suitability may be affected by supplier conditions. We are not responsible for supplier delays or changes outside our control, but we will communicate with you where these affect the job.
9. Engine and component rebuilds
Engine and component rebuilds are completed based on the condition of the equipment, parts availability and agreed scope of work.
Engine rebuild work completed by CMS may include warranty support, subject to the agreed terms, correct use, maintenance requirements and any exclusions advised at the time of the job.
Warranty support may not apply where failure is caused by misuse, incorrect operation, lack of maintenance, contamination, overheating, unauthorised repairs, site damage, incorrect fluids or other factors outside our control.
10. Ground Engaging Tools
For GET quotes and work, customers must provide accurate machine details, location, required GET, installation requirements and clear photos where possible.
Additional costs may apply if incorrect details are provided, extra parts are required, installation conditions change or further repairs are identified.
11. Labour hire
Labour hire is provided based on availability, required dates, work scope, site requirements and agreed terms.
Customers are responsible for providing a safe work environment, required site inductions, site access, supervision requirements and any relevant safety information.
Additional charges may apply for travel, accommodation, after-hours work, extended shifts, delays, inductions or site-specific requirements.
12. Dry machine hire
Dry machine hire means the machine is supplied without an operator.
Customers are responsible for ensuring that operators are suitably trained, licensed and competent to operate the hired machine.
Customers may be responsible for fuel, daily checks, safe operation, damage, cleaning, transport, insurance, site compliance and returning the machine in the agreed condition, unless otherwise agreed in writing.
Specific machine hire terms may be provided as part of the hire agreement.
13. Customer responsibilities
You agree to:
Provide accurate job and contact information
Ensure safe and reasonable access to the site, machine or vehicle
Advise us of hazards, access issues or site requirements
Ensure machinery or vehicles are available at the agreed time
Follow maintenance, safety and operating instructions
Pay invoices by the due date
Notify us promptly of any concerns with completed work
14. Payment terms
Payment terms will be set out in your quote, invoice or service agreement.
Unless otherwise agreed, payment is due by the date stated on the invoice.
Late payments may result in additional fees, suspension of services, recovery action or refusal of future bookings until outstanding amounts are paid.
15. Cancellations and delays
If you need to cancel or reschedule a booking, please provide as much notice as possible.
Cancellation fees may apply where parts have been ordered, travel has commenced, labour has been allocated, equipment has been reserved or short notice causes loss to CMS.
If our team is delayed due to site access issues, unavailable machinery, missing information or customer-related delays, additional charges may apply.
16. Warranties and consumer guarantees
Nothing in these Terms & Conditions limits any rights you may have under Australian Consumer Law.
Australian Consumer Law provides consumer guarantees for goods and services, including that services must be provided with due care and skill and be fit for purpose where applicable.
Any warranties offered by CMS are in addition to any rights that cannot be excluded under Australian law.
17. Limitation of liability
To the maximum extent permitted by law, Certified Mechanical Services is not liable for indirect, incidental or consequential loss, including loss of profit, loss of revenue, loss of production, loss of opportunity, downtime or business interruption.
Where liability cannot be excluded, our liability is limited to the resupply of services, repair of goods, replacement of goods or the cost of having services supplied again, as permitted by law.
18. Site safety
Safety matters. Not in a corporate poster way, but in the very real “people need to go home in one piece” way.
Customers must provide a safe worksite and notify CMS of any hazards, site rules, inductions, permits, isolation procedures, remote access issues or safety requirements before work begins.
CMS may refuse or pause work if conditions are unsafe.
